How to send an eviction notice by certified mail
The notice to vacate is the first step of an eviction and the one most often attacked. If the tenant can show it was not delivered the way the statute allows, the case is dismissed and the notice period starts over. Whether mail counts as delivery is a question the state answers, not the landlord, and the answers differ.
Where mail counts as delivery
- Texas. Property Code section 24.005 allows the notice to vacate to be given in person or by mail to the premises, and mail may be regular mail, registered mail, or certified mail with return receipt requested. Mail is a complete method on its own.
- California. Code of Civil Procedure section 1162 allows three methods: personal delivery; substituted service on a person of suitable age at the residence or workplace plus a mailed copy; or posting on the property plus a mailed copy. Mail is always the second half of a method, never the whole of one.
Most states sit somewhere between the two. Many allow certified mail for a lease termination or a demand for rent while requiring personal service for the court papers that follow, and the lease itself may name a method the parties agreed to. Read the statute and the lease before choosing, and when the statute lists methods, use one of them exactly.
When the clock starts
Each delivery method has its own start rule, and a notice filed one day early is the same as no notice. Where the period runs from delivery, the signed return receipt fixes the day. Where it runs from mailing, the postmark and the tracking record fix it. Either way the landlord carries the burden, so the method that produces a dated, signed record wins whenever the statute allows it.
What to keep for the court file
- A copy of the notice exactly as sent, with the date
- The USPS tracking record for the piece
- The signed return receipt, or the tracking entry showing refusal or return
- For substituted or posted service, the declaration of the person who delivered or posted it
